From Covid-19 to present days: the increasing role of remote justice

Drawing upon the findings of an empirical research project funded by the Italian Ministry of University and Research during the Covid-19 outbreak, this article explores the long-term implications of remote justice in civil proceedings within the framework of the 2022 so-called “Cartabia Reform”. Starting with an analysis of the fundamental role of the Superior Council of the Magistracy in the administration of justice during the crisis, the paper then examines the role of soft rules (e.g., guidelines, protocols, and recommendations) in managing court activities during the emergency.
